Judge Rules in Favor of Specific Media

Flash Cookie Case Dismissed

IRVINE, Calif – April 28, 2011 – Specific Media, a next generation media platform company, obtained a significant result today when the Court dismissed all claims against the company in LaCourt v. Specific Media. Consistent with Specific Media’s contention that the plaintiffs’ complaint had no merit, the Court ruled that the plaintiffs failed to demonstrate a sufficient legal and factual basis to proceed with their complaint.

“We’re very pleased with the Court’s decision to dismiss the claims at the outset,” said Drew Bordages, Specific Media’s SVP, general counsel. “Specific Media has consistently been at the forefront of protecting consumer privacy online, and the company continues to be a leader in shaping industry regulations and best practices.”

The company is an active and longstanding member of the Network Advertising Initiative (NAI), Interactive Advertising Bureau (IAB), and Digital Advertising Alliance (DAA), coalitions committed to building consumer awareness and reinforcing responsible business and data management practices in the industry. Additionally, the company was the first to implement the Advertising Option Icon across its entire network, a proactive step that empowers consumers with a better understanding of and more control over the ads that they see.

“Our business model is based on connecting consumers, content and brands in meaningful and relevant ways,” said Tim Vanderhook, CEO of Specific Media. “As such, the preservation of consumer trust is of paramount importance. That’s why we’ve always taken consumer privacy very seriously. This decision correctly recognized that the claims brought against us lacked merit. We look forward to collaborating with others in the industry to maintain transparency and protect both innovation and privacy.”

Specific Media is represented in the LaCourt litigation by a team led by Ashlie Beringer and Joshua Jessen of Gibson, Dunn & Crutcher LLP.
